Der Dallas Cowboys Runningack Ezekiel Elliott darf angeblich vorerst weiter spielen, obwohl sein Status in einem immer komplexer werdenden Rechtsstreit zweideutig bleibt.
Sowohl die NFL als auch die NFLPA haben unterschiedliche Interpretationen eines Urteils des Berufungsgerichts, das Berichten zufolge eine einstweilige Verfügung aufgehoben hatte, die Elliott’s Sperre für sechs Spiele blockierte.
Die NFLPA ist der Meinung, dass der Richter am Bezirksgericht Amos L. Mazzant die einstweilige Verfügung nicht aufheben wird, bis das Berufungsgericht über Elliott’s Antrag auf eine erneute Anhörung entschieden hat, den die NFLPA am Freitag vorlegen wollte.
Die NFL kündigte jedoch am Donnerstag an, dass die einstweilige Verfügung auf Elliott’s Sechs-Spiele-Sanktion aufgehoben worden sei und dass seine Sperre sofort aktiv werde.

On October 12, 2017, the Fifth Circuit Court of Appeals issued an opinion on the National Football League and National Football League Management Council’s appeal of the Court’s preliminary injunction in the above-styled cause of action. The Fifth Circuit vacated the Court’s preliminary injunction and remanded the case with instructions to dismiss the case. On October 13, 2017, the mandate issued forthwith. The National Football League Players Association, on its own behalf and on behalf of Ezekiel Elliott (‚NFLPA‘) filed a motion to recall the mandate. The NFLPA indicated that it intends to file a petition for rehearing and would suffer prejudice if the mandate is not recalled. The Court defers dismissing the case pursuant to the mandate until the Fifth Circuit decides the NFLPA’s motion for recall, unless otherwise instructed.

Die Anwälte von Elliott suchen eine en banc Anhörung, die eine Erweiterung der Drei-Richter-Gruppe mit sich bringt. Diese 3er Gruppe entschied zuvor 2-1 zugunsten der NFL, unter Berufung auf eine mangelnde Zuständigkeit des Amtsgerichts.
In einem aktuellen Statement der NFL heißt es: Trotz der Berichte darüber, dass er möglicherweise spielen könne, bleibt Elliott gesperrt.
The suspension of Ezekiel Elliott remains in place. The order from the district court is administrative and does not in any way change the appeals court’s order vacating the preliminary injunction. Any reporting to the contrary is inaccurate and misleading.
